SECTION 1 - INTRODUCTION

This Privacy Policy (Privacy Policy or Policy) outlines how www.baseblocks.de (the “Site” or “we”) collects, uses and discloses your personal information when you access or use our Services as defined in our Terms. This information is collected, used and disclosed in accordance with the Privacy Act 1988 (Cth) (Privacy Act).

SECTION 2 - INFORMATION COLLECTED

2.1 Information provided by you

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, contact details and email address.

We reserve the right to maintain, store and use any information or data where we reasonably believe that such action is required to comply with any legal or regulatory obligations, to prevent criminal or other unlawful activity whether immediate or in the future, or where we have a legitimate business reason to do so, including collection of amounts owed, resolving disputes, enforcing our Terms or for record keeping integrity.

You expressly consent to the use of your Personal Information for the provision of Services in accordance with our Terms.

2.2 Automatically collected Personal Information

When you browse our store, we also automatically receive information that helps us learn about your browser and operating system. 

These including your computer’s internet protocol (IP) address, operating system, web browser and device type, internet service provider, mobile phone carrier, platform type, the Website from which you came and the Website to which you are going when you leave our Services, the pages you visit and features you use on our Website, date and time stamp and cookies that may uniquely identify your browser or account.

2.3 Personal Information collected via cookies

Our Services may use small pieces of data called cookies to identify a user who engages with our Services and to compile records of a user’s history of engaging with our Services.  A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies.

This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. We may also use Google Analytics and Google Analytics Demographics and Interest Reporting and other providers to collect information regarding visitor behavior and visitor demographics on some of our Services, and to develop website content. We collect your Personal Information as outlined in this Privacy Policy for the purposes described below:

  1. for provision of the Services;
  2. register your user account and verify your identity or age;
  3. facilitate payment and processing via third party gateways and alternative payment methods (such as Paypal);
  4. or communication with you in association with the functions and features of the Services;
  5. for communicating to you any announcements and updates, updated terms, conditions and policies, security alerts, technical notices, support and administrative messages;
  6. for analysis, monitoring, development and improvement of our Services, including other products or services;
  7. for security purposes, including to protect the Services and our property from abuse, fraud, malicious, unauthorised access or potentially illegal activities, and to protect our rights, safety and property and that of our other users;
  8. for sending marketing communications to you, including notifying you of promotional or advertising offers, contests and rewards, upcoming events and other news about products and services offered by us and use of our Services;
  9. to comply with relevant laws and regulations where applicable; and

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional disclosure.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

 

By using the Site or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Site. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Site or sending an e-mail to you. Your Personal Information may be disclosed to individuals and companies, for the purposes described in this Privacy Policy, as outlined below:

5.1 Baseblocks and Related Bodies Corporate

Your Personal Information may be accessed by us, including our directors, employees, officers and contractors. You consent to us providing your Personal Information, including Sensitive Information to our Related Bodies Corporate (as defined in the Corporations Act 2001 (Cth)).

5.2 Parties required by law

Your Personal Information may be disclosed by us to any party to whom we are required by law to provide your Personal Information and to any party to whom disclosure is permitted under the Australian Privacy Principles, or where we reasonably believe that disclosure is required to comply with any court orders, subpoenas, or other legal process or investigation including by tax authorities, if such disclosure is required by law. Where possible and appropriate, we will notify you if we are required by law to disclose your Personal Information.

5.3 Direct marketing

You agree and expressly and indefinitely consent to us using or disclosing Personal Information (other than Sensitive Information) to keep you informed about our products and services and other products and services that we consider may be of interest to you. For this purpose, disclosure may be made to our third-party service providers. We may communicate with you via phone, email, social media, SMS, or regular mail. If you have indicated a preference for a method of communication, we will endeavour to use that method wherever practical to do so.

You can opt-out of direct marketing communication activities undertaken by us at any time by clicking the “unsubscribe” or “opt-out” link on email communications from us, replying ‘Stop’ to a promotional SMS or by contacting us by phone or email.

Please note that our transactional emails, such as order confirmations, may contain marketing communications including recommendations as to products you may be interested in. By making an order with us, you expressly consent to us sending you such emails containing marketing communications.

5.4 Other third parties

We may share your Personal Information with third parties if it is reasonably related to the provision of our Services. The third parties that we may share your Personal Information with includes consultants, contractors, credit agencies, debt collection agencies and other service providers to us that perform services on our behalf. Such services we procure may include identifying and disseminating advertisements, enforcement of our Terms, providing fraud detection and prevention services, processing payments or providing analytics services. We may also share your Personal Information with our business partners who offer goods or services to you jointly with us (for example, contests or promotions).

We may share your Personal Information where we have reason to believe that doing so is necessary to identify, contact or bring legal action against anyone damaging, injuring, or interfering (intentionally or unintentionally) with our rights or property, users, or anyone else who could be harmed by such activities.

We may also share your Personal Information with third parties with your consent in a separate agreement, in connection with any company transaction (such as a merger, sale of assets or shares, reorganisation, financing, change of control or acquisition of all or a portion of our business by another company or third party) or in the event of bankruptcy, dissolution, divestiture or any related or similar proceedings.

Note that we reserve the right to share your Personal Information with other third parties where, in our sole discretion, it is required to:

  1. investigate and defend ourselves against any third party claims or allegations;
  2. protect against harm to the rights, property or safety of Showpo, its users or the public as required or permitted by law; and
  3. detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.

5.5 Overseas disclosure

Please note that the Services are available worldwide. Please note that some of the parties listed above to whom your Personal Information may be disclosed and processed by, may be located overseas. You expressly consent to the disclosure of such Personal Information to the parties above, including where they are located overseas.

We use reasonable steps to ensure that these parties are either governed by substantially similar, accessible and enforceable laws to the Australian Privacy Principles or adhere to the Australian Privacy Principles, however to the maximum extent permitted by law, we are not liable for the privacy practices of such parties. Overseas organisations may be required to disclose information that we share with them under an applicable foreign law.

Please note that the transfer of your Personal Information to such overseas parties may pose risks to the security of your Personal Information as these countries may not have been issued with an adequacy decision as set out in the GDPR (see section 9) or have appropriate safeguards in place, however by providing your Personal Information to us, you acknowledge and consent to disclosure of Personal Information to such overseas recipients.

 

SECTION 6 - THIRD-PARTY SERVICES AND SOCIAL MEDIA

Our Services may, from time to time, contain links to and from Websites which are owned or operated by other parties or use services of third parties, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

You acknowledge and agree that BaseBlocks has no control over, and shall not be liable for, the privacy practices or content of these third party Websites. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

We also run pages on a number of social media platforms, including Facebook, Instagram and Google Plus (Social Media Platforms). By accessing, interacting with and using our social media pages, you agree to the terms and Privacy Policy of those Social Media Platforms. You acknowledge and agree that these Social Media Platforms may collect your information and that the privacy practices of those Social Media Platforms are not controlled by us and that we hold no responsibility for such privacy practices.

We may from time to time, have access to statistics regarding the number of views, navigation patterns, posts that you like, comment on or share and any user interactions with our social media pages and may use such information for the purpose of its marketing and promotion strategies.

 

SECTION 7 - ACCESS OR UPDATE YOUR PERSONAL INFORMATION

 

At any time, you may request access to Personal Information we hold about you. We may refuse to provide access if the law allows us to do so, in which case we will provide reasons for our decision as required by law.

We take reasonable steps to keep your Personal Information accurate, complete and up-to-date. If, at any time, you discover that information held about you is incorrect, you may contact us to have the information deleted or corrected.

You may request access to the information we hold about you, or request that we delete, update or correct any Personal Information we hold about you, by setting out your request in writing and sending it to us in accordance with our contact details below (section 12) .

BaseBlocks will process your request as soon as reasonably practicable, provided we are not otherwise prevented from doing so on legal grounds. If we are unable to meet your request, we will let you know why.

 

SECTION 8 - AGE OF CONSENT

 

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

SECTION 9. EUROPE PRIVACY RIGHTS

If you are a resident of the European Economic Area, including the European Union and Switzerland, please review these additional privacy disclosures which provide information about your rights under the EU General Data Protection Regulation (GDPR).

BaseBlocks is the data controller with respect to any data transferred from the European Economic Area to Australia. Under the GDPR, you have the right to obtain our confirmation of whether we maintain personal information relating to you in Australia. Upon request, we will provide you with access to the personal information that we hold about you. You also have the right to correct, amend, or delete the personal information we hold about you. 

Except as provided in this policy, we will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

If you wish to access, correct, amend, or delete Personal Information about you, or if you have any other inquiries or complaints, please submit a written request (refer to  section 12) to our Privacy Compliance Officer.

Although BaseBlocks makes good faith efforts to respect requests from Individuals to access or delete their Personal Information, there may be circumstances in which BaseBlocks is unable to provide access or deletion, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If BaseBlocks determines that access or deletion should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, BaseBlocks will take commercially reasonable steps to verify your identity before granting access or making any changes to your Personal Information.

SECTION 10 . CALIFORNIA PRIVACY RIGHTS

If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. This page contains our most accurate and up to date version of our Privacy Policy.
